TERMS & CONDITIONS

 

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal.

  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.

  • Day: calendar day.

  • Long-term transaction: a distance contract concerning a series of products and/or services, for which the delivery and/or performance obligations are spread over time.

  • Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them, in a way that allows future consultation and unchanged reproduction of the stored information.

  • Right of withdrawal: the consumer’s right to withdraw from the distance contract within the cooling-off period.

  • Entrepreneur: the natural or legal person offering products and/or services remotely to consumers.

  • Distance contract: a contract concluded in the context of a system organized by the entrepreneur for the remote sale of products and/or services, in which only one or more techniques for remote communication are used up to and including the conclusion of the contract.

  • Technique for remote communication: means that can be used to conclude a contract without the consumer and entrepreneur being simultaneously present in the same location.

  • Terms and Conditions: these General Terms and Conditions of the entrepreneur.

Article 2 – Identity of the Entrepreneur

Article 3 – Applicability

These terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated that the terms and conditions can be inspected at the entrepreneur’s office and will be sent free of charge upon request.

If the contract is concluded electronically, the text of these terms and conditions can be made available electronically, so that it can be easily stored by the consumer.

If specific product or service terms also apply in addition to these general terms, the consumer may invoke the most favorable provision in case of conflict.

Article 4 – The Offer

  • If an offer has a limited validity period or is made under conditions, this will be explicitly stated.

  • All offers are non-binding. Collective Oversized reserves the right to modify the offer.

  • Offers contain a clear description of the products and/or services, so that the consumer can properly assess them. Images and specifications are indicative and may differ.

  • All prices include taxes unless stated otherwise. Any additional costs, such as shipping or import duties, are listed separately.

  • Offers clearly state the rights and obligations associated with accepting the offer.

Article 5 – The Agreement

  • The agreement is concluded at the moment the consumer accepts the offer and meets the associated conditions.

  • If the agreement is concluded electronically, the entrepreneur immediately confirms receipt of the order.

  • Collective Oversized ensures appropriate security measures for electronic transactions.

  • If the entrepreneur cannot fulfill an order, this will be communicated to the consumer in a timely manner.

Article 6 – Right of Withdrawal

  • The consumer has the right to withdraw from the agreement within 14 days of receipt without giving any reason.

  • During the cooling-off period, the consumer must handle the product and packaging with care. The product may only be unpacked as far as necessary to assess its nature and properties.

  • If the consumer exercises the right of withdrawal, they must notify this in writing and return the product within 14 days.

Article 7 – Costs in Case of Withdrawal

  • The direct costs of returning the product are borne by the consumer, unless otherwise agreed.

  • Amounts already paid will be refunded within 14 days after withdrawal, provided the product has been received in good condition.

Article 8 – Exclusion of the Right of Withdrawal

  • Collective Oversized may exclude the right of withdrawal for custom-made products or products that cannot be returned for hygiene reasons (e.g., sealed clothing items).
